Oregon V Elstad OREGON v ELSTAD 470 U.S. 298, 105 S. Ct. 1285, 84 L.Ed. 2d 222 (1985) MERITS: Officers Burke and McAllister of the Polk County, Oregon Sheriff's office, on the basis of a witness' statement, obtained an arrest warrant for Michael Elstad, who was suspected of burglary. The officers went to Elstad's home and were escorted to his room by his mother. After instructing the respondent to dress and accompany them to the living room, Officer McAllister took Elstad's mother into the kitchen while Officer Burke stayed with the respondent. Without advising Elstad of his Miranda rights, Officer Burke asked him whether he was aware of the officer's reason for wanting to talk with him, and whether he knew Mr. and Mrs. Gross (the victims). Elstad stated that he knew the Grosses, and that he'd heard they'd been burglarized. Burke replied that he thought Elstad was involved in the burglary, and the respondent admitted, Yes, I was there. He was then taken to the Sheriff's office and was subsequently advised of his Miranda rights. Elstad stated that he understood his rights and that he would give a statement, which he did in detail. His confession was read back to him and read by him. Elstad initialed and signed the statement and also added a sentence (After leaving the house Robby and I went back to [the] van and Robby handed me a small bag of grass) to it. Elstad maintained that at no time did the officers make threats or promises to him. He was charged with first degree burglary and opted against a jury trial. Defense immediately moved to suppress both Elstad's initial verbal statement and the signed confession, contending that the initial statement he made at his house to Officer Burke let the cat out of the bag, causing his ensuing written confession to be tainted as fruit of the poisonous tree. The judge excluded the initial statement due to Elstad's not having been informed of his Miranda rights prior to that statement. Elstad's written confession was not excluded, as the judge did not agree that it was in any way tainted. Elstad was found guilty of first-degree burglary. APPELLATE: Oregon State Court of Appeals: Conviction reversed. The State contended that although the initial statement made by the respondent (prior to having been advised of his rights) should be inadmissible, his written confession should be allowed. The Court of Appeals, however, saw both statements as inadmissible, as there was little time between the two statements, and that was not enough time to insulate the latter statement from the effect of what went before ? the cat was sufficiently out of the bag to exert a coercive impact on [respondent's] later admissions. The Oregon Supreme Court declined the State's petition for review. The State then petitioned the U.S. Supreme Court, and certiorari was granted. ISSUE: The question in this case was whether the Self-Incrimination Clause of the Fifth Amendment requires that a confession made by a defendant, after having been advised of his Miranda rights and having waived those rights, should be excluded because of another admission made to officers by that defendant before he had been advised of his rights. ARGUMENT: Reasoning: The Court cited the following cases to illustrate and establish precedence for its reasoning: Wong Sun v. United States: Where it was established that evidence and witnesses discovered as the result of search in violation of the Fourth Amendment is considered fruit of the poisonous tree, and must be excluded. The fruit doctrine also applies to confessions. However, Wong Sun also illustrates that precise and proper advisement of Miranda rights serves to cure the condition that rendered the unwarned statement inadmissible: The warning conveys the relevant information and thereafter the suspect's choice whether to exercise his privilege to remain silent should ordinarily be viewed as an act of free will. (371 U.S. at 486) Brown v Illinois: Illustrates that a procedural Miranda violation differs from Fourth Amendment violation, as the purpose of the Fourth Amendment exclusionary rule is to curb unreasonable search. Harris v New York: The Harris Court rejected the premise that a defendant's inadmissible confession entitles that defendant to ?deny every fact disclosed or discovered as 'fruit' of his confession, free from confrontation with his prior statements. [pic] 6. 0 Materials and decorations The materials which have been used in the designing of the lobby have been meticulously chosen. The materials are durable and particularly esthetic for the lobby. They have also been chosen in accordance with the theme of the hotel which is a tropical style. Durable materials are indeed very costly but however, they can resist and maintain them with the high traffic, impact and scrapping. Tropical style Tropical chic is one of the most popular looks today. It includes comfort, warmth, and a touch of the exotic, using jungle themes, restful colors, and natural textural elements. Its a style that has fresh appeal with touches of traditional. This is not the multi-colored jungle look you might choose for a childs room. It mixes lots of texture and intricate pattern with simple details and a few large accessories. Common motifs include stylized palm trees, large leafed banana plants, monkeys, animal prints, rattan, leather, and grass cloth. The platform brought together professional content owners/providers, advertisers and content consumers/users in a platform mediated network. * Rather than choose to be a destination site or syndicate content, Hulu chose to be both by being an aggregator of online video. There were web sites that did this for user generated content but Hulu was a leader in this space for professionally generated content. * The business model for Huluââ¬â¢s platform is 100% advertising supported. * Huluââ¬â¢s platform model consists of 3 nodes ââ¬â content providers, advertisers and users * The ââ¬Ësubsidy sideââ¬â¢ in this network is the users who use the platform for free while the ââ¬Ëmoney sideââ¬â¢ is the advertisers who pay Hulu for running their advertisements. Hulu on the other hand pays content providers for showing their content on the platform. The more the number of users on Hulu the more advertisers value the platform and are attracted to advertise on it. Also, the more the content available on Hulu the more users are attracted to the platform and subsequently, the more the revenue that can be generated from advertising. * Hulu leveraged the cross side network effect between content providers and users by partnering strategically with over 170 content providers including the most popular broadcast and cable networks in the United States. The content providers ââ¬Å"participated in the value created through the distribution of their contentâ⬠, providing the incentive for them to continue their support of the Hulu platform. * Hulu partnered with 30 affiliated websites including those whose users represented 96% of the monthly unique US-based web users to bring content to its audience and to leverage the cross side network effect between users and advertisers to increase revenues. * Hulu also focused on users and offered its service free to them thereby maximising the cross-side network effects between users and advertisers on its platform resulting in increased revenues generated from advertisers. 2) Huluââ¬â¢s business strategy is to be focused ââ¬Å"on helping users find and enjoy the worldââ¬â¢s premium professionally produced content when, where and how they want itâ⬠. Hulu does this by using Internet technology to bring free content to its users anywhere at any time. Hulu is a first mover in this space and is currently enjoying the first mover advantage. However with the ubiquity of internet technology accompanied by lower costs and the commoditization of the technology, the barrier to entry will be reduced and more players will be attracted to the profitable online video business, eating into Huluââ¬â¢s profitability and success. Also, the increase in IT investments in the internet age causes ââ¬Å"a Winner-take-all dynamic and high turbulence, as each group of dominant innovators is threatened by succeeding waves of innovationâ⬠(McAfee and Brynjolfsson, 2008) in Schumpeterian competition. This makes Huluââ¬â¢s success vulnerable. The case mentions that there is already an emergence of competitive threat from ââ¬Å"TV Everywhereâ⬠and even though CEO, Jason Kilar discounts the effect on Hulu, the new entrant is gaining some clout and Broadcasting & Cable has warned that â⬠TV Everywhere was ââ¬Å"starting to look like a real competitor to Hulu.â⬠â⬠Sustained success for Hulu in what is bound to be an increasingly competitive market will depend on Huluââ¬â¢s Management and their ability to continue to maintain frugality, drive innovation, operational efficiencies and differentiate their products and services to gain competitive advantage and continue to dominate the market. 3) Input data ââ¬â Basic ââ¬â Name, Gender, Age, marital status Contact ââ¬â address (state, city, zip code), phone number Other- favourite genre, previous shows watched, sites visited previously, ratings of previous shows watched. a) BI techniques i) Using Market basket Analysis Rule: if {Gender = female} then {watches real estate shows} Action: Show Ad Selector for real estate companies and related products when a female user is on Hulu ii) Using Market basket Analysis Rule: if {Married and Age>50 and lives in California} then {has watched >2 court shows in the past and previously visited a tax filing website} Action: Approach tax filing website to place their advertisement on Hulu when court shows are playing. iii) Using user based Collaborative filtering Rule: Find users ââ¬Ësimilarââ¬â¢ to current user by choosing those with the highest similarity coefficient between them and this user on the ratings of other shows. Use a combination of their similarity coefficients to predict current userââ¬â¢s rating for a crime show. Action: if userââ¬â¢s predicted rating for the crime show is high, then advertise any new crime show when user is on Hulu or other affiliate websites. b) Monetization These techniques allow Hulu to increase the click through rates as well as transaction conversion rates for its advertisements because they are targeted at users most likely to respond. Since advertisers are interested in traffic, Hulu can increase revenues by demonstrating to advertisers the number of users that can be targeted using these techniques and the subsequent increase in click through and conversion rates. 4) IT Security Plan for Hulu a) People * Management should make security a high priority and include it in Huluââ¬â¢s business strategy * Train Hulu employees on the importance of security-keeping passwords confidential and not sharing passwords * Train employees on privacy policies b) Processes * Create security policies and procedures establishing mandatory minimum security standards * Standards should include provisions on customer privacy * Ensure all affiliate websites adhere to mandatory minimum security standards * Set procedures for security incidents * Review security policies annually to address new security threats to the online video industry c) Technology * Encrypt all customer data * Install antivirus software on all servers and computers and keep installations up to date * Have multi-site backup of data * Install monitoring software for servers and network * Incorporate systems logging to track access to Huluââ¬â¢s IT infrastructure * Ensure firewalls are installed, enabled and have sufficient filters to protect from outside intrusion * Engage ââ¬ËEthical Hackingââ¬â¢ vendors to audit systems annually in order to identify areas of vulnerability.
